CONDITIONS of USE and PRIVACY POLICY
These are "Conditions of Use and Privacy Policy” that govern the www.westarinstitute.org (“the Site”). This policy of online privacy applies only to information collected through the Site. It has no application to information collected offline.This Site is owned and operated by the Westar Institute. Westar is a non-profit public benefit corporation. This Site does have ecommerce features. By using this Site, you indicate that you have read and understand the Conditions of Use and Privacy Policy and agree to abide by it at all times. All the content published and made available on the Site is the property of the Westar Institute. This includes, but is not limited to images, text, logos, documents, downloadable files, and anything that contributes to the composition of theSite.
Links and Third Parties
Links on the Site to other websites or pages on the Site that hold links to third party websites are not evidence in any way of Westar’s influence, control, or ownership of third-party sites. Westaris not responsible for the content, policies, or practices of any third party website that holds links to the Westar Institute. It is the user’s responsibility to read the terms and conditions and privacy policies of third party websites.Westar is in no way accountable or responsible for any good or services provided or sold by third parties. Westar does not guarantee or in any way assure the accuracy of claims or the reliability of goods and services found on or through a third party site.
Accounts
When a user creates an account on the Site, the user agrees to the following:1. The user is solely responsible for the account and its security. The privacy of the account, including its passwords or any other sensitive information attached to the account is the responsibility of the user.2. The user verifies that all personal information provided to Westar through an account is accurate, up to date, and truthful. The user will update personal information if or when it changes.
Comments
Some sections on the Site allow for user comments. Sometimes comments section will be open for a limited time before being closed. Comments are reserved for respectful and considered dialogue or exchange. The user’s feedback may be posted on the Site or may be block or deleted if it fails to be decently expressed. User comments are welcomed but not endorsed by the Westar Institute. Inappropriate comments consist of inflammatory, violent, discriminatory, spam, unrelated issues, and other like expressions judged inappropriate by the Westar Institute.
USE
Permission is granted to use resources freely available on the Site to the public. When material from the Site is used, the user agrees that: 1) citations and references are not altered but remain accurate; 2) the material is not used for commercial gain; 3) the material will not be transferred in whole or in part as content of another website; 4) material will not be used without appropriate acknowledgement of the source (Westar Institute) or citation of the copyright.The user is solely responsible for respecting the integrity of material gained through the Site and solely responsible for the use of the material. The user agrees to and acknowledges that material from the Site shall not be used to harass, intimidate, or otherwise threaten or bring mischief upon others. Any unethical or illegal use of the material from the Site will result in a user membership being cancelled or being banned from engagement of the Westar community.
Information Provided to Westar
Information provided to Westar in the form of public engagement, such as comments, feedback, or other means, directed to Westar through the Site will be regarded as non-proprietary. The user accepts the condition of non-proprietary when Westar is publicly engaged.
Privacy
Westar and the Site do not seek the identity of users, do not share information collected from users. Information stored with Westar through the site is information voluntarily shared such as an email or physical address for the purpose of receiving the newsletter or appeals funds. Information obtained for these purposes is confidential.Some information is used anonymously to tract the use of or interest of users in the Sited. Such information does not identify the user but assists Westar in understanding its audience, tracking its position or interest among the family of similar site, or understanding trends such as the most frequented page or most read blog, etc. Such anonymous information may be used by Westar to issue reports to its Board of Directors or to parties interested in supporting the work of the Westar Institute.Westar does not share, sell, or otherwise distribute such information.
Copyright infringement
If a user believes that the Site has used the user’s work inappropriately such that a copyright infringement has occurred, the user is requested to contact Westar, as indicated below, to inform the institute of this event. Westar respects the intellectual property of other individuals or institutions and will act to address any such situation.
Breaches in Security
Every effort is made to ensure data held by Westar and obtained through the Site is protected from unauthorized access. Westar uses advanced systems to secure the Site. Unfortunately, systems, however advanced, can be compromised. Security systems used by Westar are judged and employed most conscientiously, but Westar is unable to make a legal guarantee of absoluteprotection.
Limitation of Liability
The Westar Institute and its Board of Directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities, or other expenses including legal fees from the use of the Site. Except where prohibited by law, by using the Westar Site the user indemnifies and hold harmless Westar and its Board of Directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities, or other expenses including legal fees arising from the use of the Site or from the violation of these Terms and Conditions.
Applicable Law
These Terms and Conditions are governed by the laws of the State of Oregon. If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.
Changes
These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Site and the way we expect users to behave on our Site. We will notify users by email of changes to these Terms and Conditions or post a notice on our Site.
